Acceptable Use Policy — EpigraphIA

This English translation is provided for convenience. In the event of any discrepancy, the Spanish version prevails.

This Policy describes what you can and cannot do with EpigraphIA. It forms part of the Terms of Service. Violating it may result in the termination of your license, the loss of support and, in serious cases, reports to the authorities. You are responsible for your use of the Service and for the Content you generate.

1. How moderation works

EpigraphIA does not pre-review your Content. The flow is:

1. You write your prompt or your Input.
2. The Input is sent to the API of the AI provider you configured (OpenAI, Anthropic, Google, Replicate, etc.).
3. The provider applies its own safety filters.
4. If the provider rejects the request, you will see an error message.
5. If it approves it, the Output is generated.

Responsibility for the filters lies with the AI provider; responsibility for legal compliance lies with you. EpigraphIA is a neutral tool and is not responsible for the decisions of third-party APIs.

2. Prohibited uses — Child safety (zero tolerance)

The following is absolutely prohibited:

• Creating, distributing or possessing child sexual abuse material (CSAM) in any form.
• Sexualizing minors in any way.
• Grooming, exploitation or solicitation of minors.

Consequences: immediate and permanent termination of the license, a report to the competent authorities (including NCMEC/FBI where applicable), and no refund. You are responsible for the legal consequences.

3. Prohibited uses — Illegal activity

• Creating malware (viruses, ransomware, worms).
• Hacking, unauthorized access or cyberattacks (including DDoS).
• Instructions for making weapons, explosives or drugs.
• Counterfeiting, fraud, money laundering, human trafficking.

4. Prohibited uses — Deception and disinformation

• Deepfakes of real people intended to deceive, defame or impersonate.
• Phishing, social engineering, spam.
• Election interference or dangerous public-health disinformation.
• Unauthorized impersonation of people or organizations.

5. Prohibited uses — Harassment and violence

• Harassment, intimidation, threats or bullying.
• Incitement to violence or harm.
• Hate speech based on protected characteristics.
• Doxxing (publishing private information without consent).

6. Prohibited uses — Intellectual property infringement

• Copying published books without permission (copyright infringement).
• Plagiarizing other people's work.
• Trademark infringement (for example, generating copyrighted or trademarked characters or logos for publication).
• Using third-party artistic works without a license.

You are liable to the rights holder for any infringement.

7. Prohibited uses — Privacy violations

• Non-consensual intimate imagery.
• Unauthorized surveillance.
• Disclosing third parties' private information (financial, medical).

8. Prohibited uses — Service abuse

• Attempting to circumvent the APIs' safety filters.
• Prompts designed to "jailbreak" the models.
• Reverse engineering EpigraphIA.
• Reselling EpigraphIA or access to its features.

9. What IS allowed

To avoid ambiguity, the following is allowed and is a legitimate part of creative work:

• Adult fiction (consensual, between adults).
• Horror, gore and dark themes in a creative context.
• Political criticism, satire and parody.
• Violence in a narrative context (novels, short stories).
• Mature themes (death, trauma, grief, etc.).

Even so, all Content must comply with: no CSAM (minors), no non-consensual imagery, and no deepfakes intended to harm real people.

10. AI-generated content and publishing (KDP)

If you publish your Content on platforms such as Amazon KDP, keep in mind that some platforms require you to disclose when content was generated with AI. EpigraphIA produces text and images with AI assistance; it is your responsibility to make the appropriate disclosures under the current policies of the platform where you publish.

11. Data research (Hunter module)

The Hunter module lets you analyze public market information. When you manually browse third-party sites (for example, online stores) and extract data from a page you visited for your personal analysis, you are responsible for complying with those sites' terms of service. EpigraphIA does not perform mass automated scraping on your behalf; features that depend on external data providers operate under the BYOK model with your own key and account.

12. Consequences of violations

• First minor violation: a warning.
• Repeated violations: suspension or termination of the license and support.
• Serious violations (CSAM, malware, etc.): immediate termination, no refund, and a report to the authorities.

13. Reports and copyright claims

If you believe any content related to EpigraphIA infringes rights, write to us at legal@xbstudios.ca. For formal copyright claims, see the DMCA Policy (separate document).

14. No liability for user content

EpigraphIA does not endorse or supervise Content created by users and is not responsible for Content that violates laws or third-party rights. If you believe any Content infringes the law or your rights, report it to legal@xbstudios.ca or go directly to the authorities.
