Xolo Beaver Studios Inc. respects intellectual property rights and handles claims in accordance with the Digital Millennium Copyright Act (DMCA) and applicable law.
1. Scope
EpigraphIA is a desktop application that does not host the content you create: your content lives on your computer. For that reason, this Policy applies mainly to:
- Content that may be hosted on online properties of Xolo Beaver Studios Inc. (for example, the website, a public gallery, or promotional materials a user has sent us for distribution).
- Claims relating to materials we control directly.
If the allegedly infringing content was published by a user on a third-party platform (for example Amazon KDP), the claim must be directed to that platform.
2. How to report copyright infringement
If you believe that content we control infringes your copyright, send a notice to legal@xbstudios.ca including:
- Your name, email, phone number, address and signature (physical or electronic).
- Identification of the protected work.
- A description and the location of the allegedly infringing material (a link, if applicable).
- A good-faith statement that the use is not authorized.
- A statement, under penalty of perjury, that the information is accurate and that you are the rights holder or are authorized to act on the holder's behalf.
We will acknowledge receipt within 5 days and investigate within 10 days.
3. Takedown process
If we determine that the content is infringing:
- We disable or remove the material.
- We notify the person who published it, indicating that it was removed due to a DMCA claim.
- That person has 30 days to file a counter-notification.
- If there is no counter-notification, the material remains disabled.
4. Counter-notification
If your content was removed and you believe it was a mistake, send the following to legal@xbstudios.ca:
- Your name, email, phone number, address and signature.
- Identification of the removed material and its previous location.
- A statement, under penalty of perjury, that the removal was the result of a mistake or misidentification.
- Your consent to the competent jurisdiction.
We will forward the counter-notification to the original claimant and may restore the material after 10 business days, unless the claimant informs us that they have filed legal action.
5. Repeat infringers
Accounts or licenses associated with repeated, valid infringements may be permanently terminated, at the discretion of Xolo Beaver Studios Inc.
6. User responsibility
You are solely responsible for the Content you generate and publish. If it infringes third-party rights, you are the one liable to the rights holder.
